Most physician employment arrangements entered into by hospitals and health systems involve direct hospital employment of the physician, rather than the formation of a hospital-controlled group practice. The federal physician self-referral (Stark) Law represents a unique opportunity for flexibility in creating and maintaining hospital-physician alignment vehicles, but has its own compliance challenges. This session will contrast direct employment with the group practice model, discuss recent cases involving direct employment, address compliance challenges with both models, and compare fair market value implications in the hospital-controlled group practice setting.
After completing this session, attendees will be able to:
- Recognize the Stark Law definition of a group practice
- Contrast, in basic terms, the requirements of the Stark group practice with the elements of the bona fide employment relationships exception of the Stark Law
- Identify compensation valuation issues unique to the hospital-owned group practice model in the preparation or review of fair market value analyses
